Terms and Conditions
The placing of an order infers the acceptance of the following terms, starting 1st January 2007

Payment
New customers must complete our credit application form before a credit account can be opened. New non-account holders must pay by pro-forma invoice. Credit accounts are strictly net, and due for payment in full within 28 days of the invoice date. Any invoice outstanding beyond this period will be referred to Daniels Silverman Limited and will be subject to a surcharge of 15% plus VAT to cover the collection costs incurred. This surcharge together with all other charges and legal fees incurred will be the responsibility of the customer and will be legally enforceable.
Law and jurisdiction
The Contract shall be governed by English law and United Kingdom courts alone shall have jurisdiction in any dispute between the supplier and the customer.
Discounts

N.B. Discounts apply to catalogue prices only and do not apply to special prices.
Cancellations
The Northern Liner Company shall be entitled to charge a sum to cover costs incurred up to the date of cancellation.
Damage or Complaints
Notification of any damages or shortages in transit must be made to ourselves in writing within seven days. Whilst every endeavour is made to keep stock true to name and healthy, our liability for plants supplied is limited to the replacement of those plants, or at our option, to a refund of the price paid. All other claims, including consequential loss, are hereby excluded.
Although the risk in goods passes to the buyer upon the goods leaving the nursery, legal title to the goods will not pass to the customer until payment in full is received. The customer shall hold goods and items as bailee only until full payment is received. It is the responsibility of the customer to maintain and grow the plants until full payment is made and legal title transferred.
