TERMS AND CONDITIONS

The placing of an order infers the acceptance of the following terms, starting 1st January 2010.This list cancels all previous lists. All prices are quoted each, ex nursery and exclusive of VAT. We reserve the right to review our prices at any time without notice. All plants are offered subject to being unsold on receipt of your order and upon satisfactory growth. All order confirmations are issued subject to satisfactory growth of the crop prior to the delivery date or period.

PAYMENT

Account: To open an account please complete our Credit Application Form which will sent out on request
Pro forma: New customers not wishing to open an account will be asked to pay prior to delivery - or by method 3 ( see below )
Credit/Debit Card: We accept only Mastercard, Visa, Maestro or Switch
Cash on Delivery/Collection: Established customers may prefer this option to take advantage of the appropriate discounts
BACS: Account customers wishing to use this method will be supplied with our bank details on request.

Credit accounts are strictly net and due for payment in full within 28 days of the invoice date. A credit charge of 2% will be added after 28 days if payment has not been received. After this period an addition of 2% per month will come into effect. Any invoice outstanding beyond this period will be referred to Recovery Agents and will be subject to a surcharge of 15% plus VAT to cover the collection costs incurred. This surcharge together with all other charges and legal fees incurred will be the responsibility of the customer and will be legally enforceable.

LAW AND JURISDICTION

English law shall govern the Contract and United Kingdom courts alone shall have jurisdiction in any dispute between the supplier and the customer

DELIVERY

The minimum quantity of liners per variety is 18. This is the number of liners our standard carrying tray holds. Where orders are not placed in multiples of 18, we reserve the right to adjust quantities where appropriate. The minimum number of rooted cuttings per variety is 84.

UK deliveries will be made, wherever possible, on our transport using black-padlocked Danish Trolleys and returnable carrier trays. Where carrier trays are not made available for return or collection, a charge of 50p per tray will be made.

COLLECTIONS

A minimum of 72 hours notice is required for collection from our nursery.

MINIMUM DELIVERY

The minimum total order for delivery is 500 liners or 3000 plugs. (smaller quantities may be delivered by carrier at cost). If carriers are used please unpack plants immediately upon receipt. Before signing the carrier’s documentation please check that the stock has arrived in good condition.

DELIVERY COSTS

Mainland UK free of charge. ( See excluded areas )

Excluded areas: Highland & Islands, Argyll & Bute, Gwynedd, Powys, Ceredigion, Pembrokeshire & Carmarthenshire.
Deliveries to these areas will be charged at cost.

Deliveries to Ireland will be on Danish Trolleys wherever possible and charged at £45.00 per Danish Trolley.

Deliveries outside the UK mainland will be effected by the most economical means and will be charged at cost.

Discounts

Cash on Delivery	2.5%
Cash on Collection (over 500 liners or 3000 plugs)	5.0%
Total annual order with invoice values of over £5000	5.0%

N.B. Discounts apply to catalogue prices only and do not apply to special prices.

Cancellations

The Northern Liner Company shall be entitled to charge a sum to cover costs incurred up to the date of cancellation, on all stock grown to order.

Damage or Complaints

Notification of any damages or shortages in transit must be made to ourselves in writing within seven days. Whilst every endeavour is made to keep stock true to name and healthy, our liability for plants supplied is limited to the replacement of those plants, or at our discretion, to a refund of the price paid. All other claims, including consequential loss, are hereby excluded. Although the risk in goods passes to the buyer upon the goods leaving the nursery, legal title to the goods will not pass to the customer until payment in full is received. The customer shall hold goods and items as bailee only until full payment is received. It is the responsibility of the customer to maintain and grow the plants until full payment is made and legal title transferred.
